This Agreement is entered into with Empire Grove LLC, which operates New Hope Tennis Club, together with its members, owners, and agents (the “Club”), regarding tennis activities and events held at the Club’s private residence and court in New Hope, Pennsylvania (the “Premises”).
1. Assumption of Risk
I understand that tennis and presence on the Premises involve inherent risks of injury, including slips and falls, contact with balls or equipment, overexertion, weather conditions, and travel to and from the Premises. I further understand that a swimming pool and other features are present on the property. Knowing these risks, I voluntarily choose to participate and accept full responsibility for them.
2. Release and Waiver of Liability
In consideration of being permitted to participate, I release, waive, and discharge the Club from any and all claims, demands, or causes of action for injury, loss, or damage to me or my property arising out of my participation or presence on the Premises, including claims arising from the Club’s own negligence, to the fullest extent permitted by Pennsylvania law.
As the parent or legal guardian of the named minor, in consideration of the minor being permitted to participate, I release, waive, and discharge the Club from any and all claims that I personally may have, including claims for medical expenses I incur and for loss of the minor’s services, arising out of the minor’s participation or presence on the Premises, including claims arising from the Club’s own negligence, to the fullest extent permitted by Pennsylvania law. I acknowledge I have been fully informed of the risks above and voluntarily allow the minor to participate.
3. Rules, Conduct & Supervision
I agree to follow all instructions and Club rules. The swimming pool and any water features are strictly off-limits to participants during sessions except with the express permission and direct supervision of an adult responsible for the participant.
The Club provides tennis instruction and organized events, not childcare or custodial supervision. The parent or legal guardian of a minor remains responsible for the minor at all times before and after the scheduled session, including drop-off and pick-up and any time the minor is on or near the Premises outside session activities. A parent or guardian who chooses to drop the minor off and leave the Premises does so having assessed and accepted the level of supervision the Club provides, and continues to be responsible for the minor.
4. Emergency Medical Authorization (optional)
If I opt in below, I authorize the Club to seek and consent to emergency medical treatment for the minor if the minor is injured and I cannot be reached. I am responsible for any resulting costs.
5. Media Release (optional)
If I opt in below, I grant the Club permission to photograph and video-record the participant during sessions, and to use those images and recordings in any medium, including the Club’s website, social media, and printed or digital promotional materials, to promote the Club, without compensation and on a royalty-free basis. This permission is entirely voluntary, is not a condition of participating, and may be withdrawn at any time by written notice (applying to future use). For a participant under 18, this consent is given by the parent or legal guardian.
